Called to Order at 7:30 PM under M.G.L. c 131, §40 and the Hanson By-Law 3-13, §5 and Rules and Regulations by Philip R. Lindquist, Chairman, in Meeting Room A at the Town Hall.

Public Hearings

7:30 PM Continued Notice of Intent for an Aquatic Management Program for the Pembroke Watershed Association represented by Aquatic Control Technology, Inc., 11 John Road, Sutton, MA  01590.  (DEP #SE175-0571)

7:45 PM  Notice of Intent for the construction of a single family dwelling with septic system, well, site grading and landscaping within 100 feet of a Bordering Vegetated Wetland at Union Park Street, Map 2, Lots 358 & 361 for Elko Construction Corp. represented by Vautrinot Land Surveying, Inc., P.O. Box 144, Plympton, MA  (DEP #SE175-0586) (New Hearing)

Frank Schellenger read the Public Hearing Notice and the abutters were verified.  Mr. Al Vautrinot made the presentation for a proposal of a single-family house on an undeveloped property.  The wetland was delineated by Bill Woodward on 11/11/09.  The proposal meets the 50-foot no disturb setback with the exception of a deck, the well and a portion of the backyard.                    For this reason, the applicant was requesting a variance from the 50-foot NDS.  Mr. Kemmett read the abutters list.  Those present were:

Justin Vieira – Doesn’t like the idea of a house there.  He had been told that it was wetlands and Conservation land and that it would never be developed.


John Connolly – Submitted pictures of evidence of flooding onto his property purportedly from the wetland in question.  He was concerned about drainage.  Also, there was a tree left overhanging onto his property from the perc testing.
Edward Lynch – Also concerned with drainage.  Has lived there for 40 years.  He was of the opinion that it was not a good idea because of all the wetlands.  
Brian Campbell – His concern was the intermittent stream that floods during heavy rainfall and gets very high.  He also thought the proposed well was too close to his property line.
Judy Sansone – She is not a direct abutter, but was concerned with displacement of water.  Her basement sump goes from November through July every year.  

Mr. Vautrinot commented that a stone swale is proposed along the driveway to catch runoff and the well is 10 feet off the property line.  Mr. Vacca, reading from his agent’s report (attached), summarized his comments.  Mr. Vacca then reminded Mr. Vautrinot that it is generally the Commission’s policy to not allow activity within the 50-foot no disturb zone for new construction other than to gain access to an upland area.  In addition, he recommended that the proposed driveway be paved in lieu of gravel and mentioned that the Massachusetts’s Stormwater Management Policy does not endorse drywells.   Mr. Lindquist asked if the septic had been approved by the Board of Health.  Mr. Vautrinot answered no, they hadn’t submitted plans yet because if the Commission asked for changes, it would be costly to redo the plans.
Mr. Schellenger asked that a P.E. stamp the plan.   Mr. Schellenger questioned whether the proposed driveway was actually a street and belonged to the Town.  If so, the lot(s) would be landlocked.  Mr. Lindquist said that that was a Planning Board issue in terms of Adequate Access.

Mr. Campbell reiterated that the site was left a mess after perc testing.  A large pine tree was left leaning and he was of the opinion that it was unsafe.  Mr. Lindquist instructed Mr. Vacca to take appropriate action (fine) against the applicant for not having filed for a requisite permit to conduct the perc tests.  Mr. Don Ellis said he would remove the leaning tree tomorrow.

Discussions
Cash Flow Projection Project
Mr. Vacca reported that in terms of the budgeting process, he was asked to scrutinize the filing fees over the past few years to come up with a reasonable projection.  Matt Dyer, our High School intern had created an Excel spreadsheet after inputting data from turnover sheets and possibly will be able to create graphs to scale our budgets for the future.

Mr. Vacca reported that he is working with Brendan to come up with a suitable project.  He has scheduled a meeting with him next Thursday and if anyone had any ideas to let Rich know.  
TRWA Mini Grant – Wampanoag Canoe Passage, Stetson Brook to Stetson Pond
Mr. Vacca requested that the Commission support the application for a grant from the Taunton River Watershed Association.   The TRWA has supported Hanson in the past by granting two-thousand dollars towards the creation of the Open Space and Recreation Plan.  This was accomplished in 2009.   A grant at this time would allow the Commission to hire a consultant to produce maps and/or drawings of the Stetson Brook Corridor.  This idea comes from the Open Space Plan itself under Goals and Objectives.  Mr. Vacca also suggested we explore the possibility of Pembroke and Halifax being involved as the corridor runs through those towns  giving the project regional importance.
